{"id":58467,"date":"2017-10-19T11:52:12","date_gmt":"2017-10-19T15:52:12","guid":{"rendered":"https:\/\/savard.work\/project\/exclusion-du-quebec-cause\/"},"modified":"2022-01-11T15:58:08","modified_gmt":"2022-01-11T20:58:08","slug":"exclusion-of-quebec-cause","status":"publish","type":"dt_portfolio","link":"https:\/\/savard.work\/en\/project\/exclusion-of-quebec-cause\/","title":{"rendered":"Exclusion of Quebec (Cause)"},"content":{"rendered":"<p>[vc_row][vc_column]<div class=\"dt-fancy-separator title-left h3-size style-double\" style=\"width: 100%;\"><div class=\"dt-fancy-title\"><span class=\"separator-holder separator-left\"><\/span>IMPORTANT UPDATE<span class=\"separator-holder separator-right\"><\/span><\/div><\/div>[vc_column_text]On June 2, 2021, the RACJ officially announced a <a href=\"https:\/\/www.racj.gouv.qc.ca\/en\/communications\/news\/detail.html?tx_news_pi1%5Bnews%5D=643&amp;tx_news_pi1%5Bcontroller%5D=News&amp;tx_news_pi1%5Baction%5D=detail&amp;cHash=62ddd9c3f82e4308f8d5f17f92284714\" target=\"_blank\" rel=\"noopener\">legislation relaxation<\/a>:[\/vc_column_text]<blockquote class=\"text-big shortcode-blockquote\"><p>Amendments to the\u00a0<em>Act respecting lotteries, publicity contests and amusement machines<\/em>\u00a0came into effect on June\u00a02,\u00a02021.<\/p>\n<p>Enterprises that hold international contests no longer have to complete paperwork or pay the regulatory fees previously required by the R\u00e9gie. The relaxation, considered in the interest of fairness, will promote the inclusion of the population of Qu\u00e9bec in international publicity contests.<\/p>\n<\/blockquote>[vc_single_image image=&#8221;58797&#8243; img_size=&#8221;full&#8221; alignment=&#8221;center&#8221;][vc_separator style=&#8221;double&#8221; border_width=&#8221;5&#8243;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]I\u2019ve been fighting since 2013-2014 against the exclusion of Quebec residents from international esports event and now that we finally succeeded to prove that esports aren\u2019t a publicity contest and there is no legal reason to exclude us, I\u2019m realizing that some companies, like MLG, just don\u2019t want to cooperate.<\/p>\n<p><strong>Why is Quebec excluded?<\/strong><\/p>\n<p>A simple misunderstanding\u2026<\/p>\n<p>The FQSE asked the R\u00e9gie des alcools, des courses et des jeux du Qu\u00e9bec (RACJ) to clarify the judicial status of esports competitions, the RACJ examined the issue and stated, in an official letter dated from November 15, 2016, that e-sports competitions <strong>were not<\/strong>\u00a0considered \u201cpublicity contests\u201d as defined by legislation.<\/p>\n<p>Official letter (English version) :\u00a0<a href=\"https:\/\/leonin.ca\/wp-content\/uploads\/2017\/07\/FQSE-Letter-from-the-RACJ-of-Quebec.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">HERE<\/a><br \/>\nOfficial letter (French version) :\u00a0<a href=\"https:\/\/leonin.ca\/wp-content\/uploads\/2017\/07\/FQSE-Lettre-de-la-RAJC-FR.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">HERE<\/a><\/p>\n<p>Therefore, these competitions are not under the jurisdiction of the RACJ, and the organizers are not required to report the hosting of such events or to pay related fees. Indeed, the RACJ views esports tournaments as events in which there is a form of competition that relies on the players\u2019 skills:[\/vc_column_text]<blockquote class=\"text-big shortcode-blockquote\"><p>Since esport focuses on players\u2019 personal skills, its main purpose is not for commercial purposes, but rather to allow video gamers to compete with each other to determine who is the most skillful and, as in all competitions, to award a prize to the most talented participants.<\/p>\n<\/blockquote>[vc_column_text]As a reminder, the ambiguity surrounding the legal status of esport competitions previously caused the exclusion of Quebec residents in some international competitions. By putting an end to this ambiguity, the notice from the RACJ is a key argument in convincing the organizers of such competitions to welcome Quebec players.[\/vc_column_text][vc_row_inner][vc_column_inner width=&#8221;2\/3&#8243;][vc_column_text]Over the years, I&#8217;ve managed to have the exclusion removed from a multitude of major events (e.g. Blizzcon, UMG and TESPA) as well as official studio tournaments (e.g. Nintendo, EA, Riot).
